This week you learned about the “Motion to Dismiss.” The most common use of this motion is under Fed. R. Civ. R 12(b)(6), or your state’s
equivalent, for a failure to state a claim upon which relief can be granted. However, there are other occasions on which a Motion to Dismiss
can be filed. Do some research and explain the various situations where a Motion to Dismiss would be filed, other than a 12(b)(6) motion. Is
there ever a time that outside documents such as a police report ordeposition transcript could be used in support of a Motion to Dismiss?
