Jurisdictions

Jurisdictions

The FBI has contracted with your company to help create a plan for dealing with cyber crime across state and national borders. Research jurisdictional issues in prosecuting cybercrime cases, both domestically between jurisdictions and globally from one country to another.

Prepare a PowerPoint presentation of 8-10 slides that addresses these points:

  • How does law enforcement handle a cyber crime that spans state lines? For example, if a hacker in Virginia is determined to have stolen information through the internet from a company in California, how will law enforcement proceed? Who is responsible for investigating and prosecuting such a case?
  • How does federal law enforcement react to cyber crimes that cross national borders? Online gambling is illegal in the Unites States, but perfectly legal in Costa Rica. Can the United States prosecute an American who is found to be using a Costa Rica website to place bets?
  • Of course there are some crimes that are illegal in all countries. While gambling laws may differ from place to place, it is illegal virtually everywhere to steal money, traffic in drugs, or raise money to support terrorist organizations. When such crimes take place across national borders, how do the countries involved handle the situation? Is there any procedure in place for different countries to co-operate in countering cross-border cybercrime?
